Case Summaries
A brief overview of three matters we have assisted with — names and identifying details changed to preserve confidentiality.
Situation
A client was charged under the Penal Code following an altercation. The prosecution's case relied primarily on witness testimony. The client had limited understanding of the process and was concerned about the bail position.
Approach
A bail application was filed promptly. Representations were made on the client's background and ties to the jurisdiction. The charge sheet and witness statements were reviewed carefully, and gaps in the prosecution's account were identified early.
Outcome
Bail was granted. Following cross-examination of prosecution witnesses at trial, the charge was not established to the required standard. The matter concluded in the client's favour at the Sessions Court level within eight months of the initial charge.
Situation
A client sought to dissolve her marriage and establish custody arrangements for two young children. There was also a jointly-owned property and maintenance dispute to address. She was uncertain which proceedings to begin first and which courts were involved.
Approach
We advised on jurisdiction and sequencing — explaining which matters were within Syariah court authority and which required civil proceedings. The fasakh application was filed in the Wilayah Persekutuan Syariah Court alongside a hadhanah application.
Outcome
The dissolution was granted. Interim custody was secured at an early stage, with a final custody order following three months later. The harta sepencarian claim was settled by agreement before a contested hearing, avoiding further prolonged proceedings.
Situation
A client purchased a leasehold apartment in KL. The title search revealed an outstanding private caveat lodged by a third party, and the remaining lease period raised a question about the bank's willingness to extend full financing.
Approach
We identified the caveat issue early and advised the client before the SPA was signed. Representations were made to the vendor's solicitors and the caveat was removed as a pre-condition of the transaction proceeding. Discussions with the financier addressed the leasehold term.
Outcome
The caveat was withdrawn within three weeks. Financing was confirmed on terms acceptable to the client. The transfer was completed at the land office on schedule, approximately five months after SPA execution, with no further title complications.
